These vendors may need Personal Information about you to perform their functions, but we contractually restrict these vendors from using such Personal Information for their own purposes.


With Our Licensors, Manufacturers, and Affiliates. We may disclose the Personal Information collected through the Site with our Affiliates, manufacturers, and licensors (collectively “Other Parties”). The term “Affiliate” means any entity that is controlled, directly or indirectly, by a2MC, including all wholly owned subsidiaries of a2MC. Our Other Parties may use the information in all the ways listed in this Policy, provided that such use relates to services authorized by a2MC.


Other third parties. We disclose Personal Information to:

  • Other third parties with your consent or at your direction. We may disclose Personal Information to other third parties if you give us your consent or direct us to do so, including as described in any click–through agreement to which you agree.
  • Third-party marketing and analytics providers. We may disclose Personal Information, including IP addresses, other unique identifiers, and browsing information to third party marketing and analytics providers for marketing-related purposes.
  • Third parties for business negotiations. We may contemplate, for strategic or other reasons, selling, buying, merging, or otherwise reorganizing one or more of our businesses. This U.S. State Supplemental Privacy Policy ("Supplemental Policy") is provided by The a2 Milk Company (“a2MC” “we,” “us,” or “our”), and applies solely to Personal Information that we collect and use relating to individuals who reside in U.S. states with comprehensive privacy legislation that applies to us and to healthcare professionals and other business contacts with whom we interact in a commercial context who are residents of California ("you" or "consumer"). This Supplemental Policy supplements our general Privacy Policy and is parallel in scope to our Privacy Policy. We provide this Supplemental Policy to comply with U.S. state comprehensive privacy laws, including the California Consumer Privacy Act of 2018, as amended ("CCPA"), and similar legislation in other states, to the extent they apply to us (collectively, “U.S. Privacy Laws”).

Some portions of this Supplemental Policy apply only to consumers of particular states. In those instances, we have indicated that such language applies only to those consumers.

Please note that this Supplemental Policy does not apply to individuals with whom we interact in an employment-related context. 


Definitions

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. “Vendor” means a service provider, contractor, or processor as those terms are defined in the U.S. Privacy Laws.

“Third Party” has the meanings afforded to it in the U.S. Privacy Laws.

To the extent other terms used in this Supplemental Policy are defined terms under the U.S. Privacy Laws, they shall have the meanings afforded to them in those statutes, whether or not capitalized herein. As there are some variations between such definitions in each of the U.S. Privacy Laws, the definitions applicable to you are those provided in the statute for the state in which you are a consumer. We will not attempt to re-identify the information, except that we may attempt to re-identify the information solely for the purpose of determining whether our de-identification processes satisfy applicable legal requirements. After it has been de-identified, the information is no longer Personal Information and is not subject to this Policy.

Disclosure for California Consumers: We sell and share, and we have sold and shared Personal Information, as detailed in the above chart, about California consumers in the past twelve months for marketing and analytics purposes. However, we do not have actual knowledge that we sell or share Personal Information of California consumers who are under 16 years of age. For purposes of the CCPA, a “sale” is the disclosure of Personal Information to a Third Party for monetary or other valuable consideration, and a “share” is the disclosure of Personal Information to a Third Party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration. You have the right to opt out of sale and sharing of your Personal Information. Retention of Personal Information. We retain your Personal Information for the period reasonably necessary to provide goods and services to you and for the period reasonably necessary to support our business operational purposes listed in this Supplemental Policy.


Data Subject Rights

  • Data Subject Rights Disclosure: Consumers who reside in states with U.S. Privacy Laws have the following rights regarding our collection and use of the Personal Information, subject to certain exceptions. Please read this section carefully as some rights vary by state. Please note that if you are a healthcare provider or other business contact, this section only applies to you if you are a resident of California. 
    • Rights that Require Verification.
      • Right to Know: You have the right to know the following details about our privacy practices at or before the point of collection. We have provided such information in this Supplemental Policy. You may also request that we provide you with information about the following aspects of how we have handled your Personal Information specifically in the 12 months preceding your request:
        • The categories of Personal Information we have collected about you;
        • The categories of sources from which we collected such Personal Information;
        • The business or commercial purpose for collecting, selling, or sharing Personal Information about you;
        • The categories of Personal Information about you that we disclosed and the categories of Third Parties, or Vendors, to whom we disclosed such Personal Information; 
        • The categories of Personal Information about you that we sold, shared, or used for targeted advertising purposes, and the categories of Third Parties with whom we sold or shared such Personal Information;

      • Right to Correction: You may request that we correct any inaccurate Personal Information we maintain about you. Please note this right does not apply to Iowa and Utah residents. 
      • Right to Access Specific Pieces of Personal Information and Data Portability: You may ask to obtain the specific pieces of Personal Information we have collected about you in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the Personal Information to another entity without hindrance. You may not exercise this right more than two times in a calendar year.

    • Rights that Do Not Require Verification.
      • Right to Opt-Out of Sale: You have the right to opt out of the sale of your Personal Information.
      • Right to Opt-Out of the Sharing of Your Personal Information or the Use of Your Personal Information for Targeted Advertising. You have the right to opt-out of the sharing of your Personal Information or our use of your Personal Information for targeted advertising purposes.
      • Right to Limit the Use of Your Sensitive Personal Information. We do not process sensitive Personal Information for purposes not permitted by the CCPA regulations. But if we did, you would have the right to limit the use of your Sensitive Personal Information to the purposes permitted by the CCPA. 


  • Opt-Out Preference Signals. We recognize opt-out preference signals that we are required to recognize for compliance with applicable law. Where required by law, we treat such opt-out preference signals as a valid request to opt-out of sale and sharing for the browser or device through which the signal is sent and any consumer profile we have associated with that browser or device, including pseudonymous profiles. Further, if we know the identity of the consumer from the opt-out preference signal, we will also treat the opt-out preference signal as a valid request to opt out of sale and sharing for such consumer. Consumers may use opt-out preference signals by downloading or otherwise activating them for use on supported browsers and setting them to send opt-out preference signals to websites they visit. Please note that we while we recognize opt-out preference signals we are required to recognize by law, we do not currently recognize “Do Not Track” signals which are different from the opt-out preference signals described above.
     

Exercising Data Subject Rights

To opt out of sales of your Personal Information, sharing of your Personal Information, and the processing of your Personal Information for purposes of targeted advertising collected via Cookies, click here to open our cookie preferences center, switch the toggle next to “Do Not Sell or Share My Personal Information” to the right, and click “save.” To opt out of sale of your Personal Information, sharing of your Personal Information, or the processing of your Personal Information for purposes of targeted advertising collected in other contexts, click here and fill out the webform or call us at 1-844-422-6455. Consumers in some states may also authorize an agent to make data subject requests on their behalf. In such instances, authorized agents may use the same methods as consumers to submit data rights requests on consumers’ behalf.


Verification Process

To ensure the security of the information we store and consumers’ privacy, and depending on the type of request you submit, we may verify that you are appropriately affiliated with the subject of the request, either as the consumer or as an authorized agent or guardian of the consumer. We may ask you to provide a few pieces of information to confirm your identity in our records.

We will only send verification questions from [email protected]. Before sending a verification response, please double-check the email address. If you receive an email that appears to be from us but is not from our verification email address listed above, please do not respond.

Any information we gather through this process will only be used for consumer verification, security procedures, or fraud-prevention. We will delete any verification information as soon as practical after processing your request.

In some instances, we may decline to honor your request if an exception applies under applicable law. We will respond to your request consistent with applicable law.

Appeals. Consumers of certain states have the right to appeal our decisions on their data subject requests. This section does not apply to California or Utah consumers, or to consumers who reside in other states where the applicable U.S. Privacy Law does not give them the right to appeal controllers’ decisions regarding data subject rights. Please enclose a copy of or otherwise specifically reference our decision on your data subject request, so that we may adequately address your appeal. Additional Disclosures

  • Non-Discrimination. We will not discriminate against you for exercising any of your data subject rights. Please note that a legitimate denial of a data subject request is not discriminatory, nor is charging a fee for excessive or repetitive consumer requests as permitted by U.S. Privacy Laws.
  • Financial Incentive Disclosure for California and Colorado Consumers. We may provide financial incentives or bona fide loyalty programs to consumers who allow us to retain and disclose their Personal Information. These incentives may include payments to consumers for winning a contest, a lower price for goods or services, and/or a higher level of goods or services. You may withdraw from the incentive at any time by emailing us at [email protected] or clicking here. The incentives we provide are as follows:
    • Gift cards, prizes, and giveaways

The categories of Personal Information we collect and sell through incentives include first name, last name, email address, and mailing address. We may disclose or sell these categories of Personal Information to our vendors, affiliates, business partners, online advertisers, and online analytics providers.  

When exercising your rights under this Supplemental Policy, if you submit a request to delete your Personal Information, this will prevent your participation in our incentives, and we must treat such an election as a withdraw from our incentives. 

Our incentive is permissible under the US Privacy Laws because we use incentives to raise awareness of our great products. We estimate that value at $35,000 per year, and we arrived at that figure by estimating the value of our incentives.

  • Direct Marketing Disclosure for California Consumers. California Civil Code § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to other parties for their direct marketing purposes.   • Disclosure for Nevada Residents. We sell “Covered Information” as defined under Nevada law, but we generally do not disclose or share “Personal Information” as defined under Nevada law for commercial purposes. Under Nevada law, you have the right to direct us to not sell your Covered Information to third parties, as defined under Nevada law.   • Changes to Our Supplemental Policy. We may update or modify this Supplemental Policy at any time.
